This is a very interesting article written by one Gabriel Claycamp who now runs a food product development company back east, who I happened to become friends with when he moved into my area and opened a restaurant. He's lived more lives than a cat. I'm unaware of the Chobani lawsuit (I detest yoghurt, for one) but the way in which Gabe thoughtfully reasons through the FDA process from all sides of the equation shed a lot of light on my understanding of how these things come about.

Nice article but if you'd like to find a villain here, I've got one for you: the law firms "representing" the plaintiffs are actually ambulance chasers (of the class action suit variety). When they became aware of Chobani's label, they sought out consumers in order to bring the case.

And you know why: they'll get 33% of the requested $5M settlement! Far, far more than anybody they are "representing".

Pure lawyerly greed. No normal person sues a company over a $2 tub of yogurt; only lawyers do that.

ETA: Upon reflection, I'm none too fond of the FDA, either: talking out of both sides of their mouth. Either the "guidance" is binding in some way or it's not worth the breath to utter it.
