SFChron: Ugly GoingOns In Livermore

by TomHill » Sat Dec 03, 2011 7:04 pm

From today's SFChron:
MitchellKatz

I've tried a fair number of the MitchellKatz wines and thought them some of the best being made in Livermore.
So sad.

Sigh. These "dirty DUIs" leave me so conflicted. Obviously, it's a good thing when private citizens alert the police to crime. Equally obviously, it's bad and a crime to drive while impaired (including overtired, drugs, cell phone, whatever). And it doesn't matter how attractive the lady "producing" a TV series is, you shouldn't let her determine how much you drink, even if you're not driving. At the same time, to (allegedly) get the police involved under these circumstances is really shady. If I had to choose, everybody goes to jail! Katz for the (alleged) DUI, the cop for the (alleged) bribe, and the folks (allegedly) plying Katz with wine, as accessories to the (alleged) DUI. Fair? ;)

That said, Katz has a lot of potential. I hope he learned a painful, difficult lesson, but can recover. And nobody involved in this sordid affair ever puts themselves in that situation again.

Seems to me, Walt, that this is a classic example of entrapment. I don't know the law well enough to know if there's any provision for the enticement arising from collusion with a second party, but I'd doubt that such cases wouldn't be covered by the relevant statutes. Still, I do agree that Katz was culpable for getting into that car regardless of the circumstances. His libido should be the last concern, not the primary one.

Only in America:

Gagen said Butler had been given 10 handguns by Glock, which was sponsoring the detective's attempt to land a reality TV show tentatively called "P.I. Moms of San Francisco."
