Could this be the year those that live in the Free State (Maryland) are finally granted our constitutional right to engage in interstate commerce?

Wine shipment bill has support from majority of Maryland lawmakers

Maryland wine lovers may soon rejoice. Legislation that would allow state residents to order bottles of their favorite pinot noir and chardonnay directly to their homes this year has broad bipartisan support from a majority of lawmakers, including some powerful names, in the House and Senate.

Maryland would join 37 other states and the District in allowing direct wine shipment from vineyards. The legislation, sponsored by Sen. Jamie Raskin (D-Montgomery) and Del. Jolene Ivey (D-Prince George's), has the backing of 32 of 47 senators and 83 of 141 delegates. Among the co-sponsors are House Speaker Michael Busch and Del. Dereck Davis (D-Prince George's), who chairs the Economic Matters Committee.

But a key component of the bill will likely face stiff opposition from the powerful alcohol industry. As written, the measure would allow consumers to buy wine directly from out-of-state retailers.

Anticipating such opposition, Davis said last week, "I'm going to do what I can to forge a consensus." A compromise bill, for instance, could allow direct shipment from wineries - but not from out-of-state retailers.

A report issued by Comptroller Peter Franchot in December looked at the practice in other states and found that direct shipment from out-of-state retailers "would have a negative effect on 'in-state licensees,' because purchases from retailers are primarily motivated by 'price.'"

I have not followed this closely but I thought the Gov said that he would sign it if passed. I also believe that the comptroller report suports the bill and is instrumental in debunking the underage access to alcohol argument. Its still Maryland but I do believe its going to be hard for it not to pass this time.

I heard this report on television. I could not believe my ears! Could I finally be able to order Stone Woll and ESJ? I will belive it when I see it.

With majorities in both houses co-sponsoring the bill, the only way this doesn't pass is if there are backroom shenanigans (I'm being polite here) between the Forces of Evil and the leadership in one or both chambers. But given the way things work in Annapolis and past history, that remains a distinct possibility. The best way to prevent this from happening is for those of us who want change to write and call and keep shouting and shining a spotlight until this actually does become law.

I was just looking at the Argyle winery website and it listed Maryland among those states to which they cannot legally ship wine and I thought how sad for the residents of Maryland. (Not just missing out on Argyle wines but on a multitude of wines available in other states.)

Yes but to be honest, I don't know many folks that let that stop them if they really are interested something. I have a place in DC that will receive for me while I know others that have stuff sent to VA. I have also used third party shippers in the past which I believe to be illegal but the companies doing the shipping claim its legal.

My fingers are crossed! I will gladly give up direct shipments from retailers in favor of direct shipments from wineries! Like many others, I am currently receiving offers for the hard-to-find new releases from many wineries and, while I can and have had wine shipped to my office, I know it isn't exactly kosher; I'd much rather get wine sent to my home in MD.

When I lived in Maryland (several decades ago) I was even cautious about how many bottles I would purchase at a time from a DC store. I heard that if you were caught bringing cases back into Maryland they could confiscate your car! And when I moved from California to Maryland I contacted the authorities to see how much liquor and wine I could legally bring in my car. I gave away bottles of wine in excess of what I could transport (which made me popular with my friends).
