Wash. D.C. wine shipping problem

by Jim Grow » Fri Apr 23, 2010 3:12 pm

I bought and paid for a case of wine last June at Chevy Chase Liquors that I would pick up in Oct. Then my travel plans fell through and I asked them to ship. No, they do not ship but will hold the wine indefinitely until I pick it up. I have been getting shipments from Schnieder's in downtown D.C. so I asked Chevy if they would deliver it to them for them to ship to me. No again as they tell me that it is illegal for one retailer to deliver wine to another retailer. Is this true? They would deliver to a local address but there is nobody I know well enough to ask that imposition to. Maybe this October???

I think it is illegal (three tier thing).

Just curious what you got at CC? I usually only go to them for beer, at which the excel.

Hard to believe but there's no shipping in or out of Maryland or even within Maryland...even store to store. Did you say that Chevy Chase will deliver to a local address? I find that hard to believe. Someone will have to go pick up the wine. I do not have a car in DC, do not drive to work and I live quite a ways away. However, if I find that I'm going to drive into town, I will let you know. Nothing would make me happier that to be instrumental in sloving this problem. Liz might be driving in on the 11th of May but that's up in the air. I'd then have to go to a UPS store or somesuch place and ship it to you, I guess. Maybe someone who drives in every day or lives in town will step up.

I think it's not the local address that's the problem it's that the address is another licensed establishment. There a few stores around town that do deliveries.

I'd go get it for you since it's not far from me, but if you read the other thread about UPS nabbing unlicensed shippers I'd think you'd want to stay on the far side of legal.

The wine in question is the 2003 (maybe the 2001, can't remember)Havens Bourriquot and I would be more than happy to ship a styrofoam shipper to anyone in the area that could help me out of this situation. Keep a couple of bottles as an appreciation of the help. I seriously doubt that since Schneiders ships, and a friend 2 years ago shipped from very near Calverts at a UPS store that there would be any problem. PM me anyone willing to help me out here.

Jim,

Schneiders used to ship to me here in Kentucky, but somehow they figured out that Ky is a felony state, and will no longer ship here. A word of caution about shipping is that if somehow the authorities find out it is wine being shipped either from, or through Maryland, they are very subject to confiscation and you lose the entire investment. YMMV, but is pretty much buyer beware.

I's my understanding that any shipper, USPS, USP, FexEx, etc, located within DC would be able to ship it to any state that allows shipping, home address or business address.

Jon, I am sure you are right regarding a shipper in DC, and I must admit that hearsay is all I have to go on, but AFAIK if it gets shipped through MD, it is contraband or something like that, and is subject to confiscation. I am sure not an expert on the subject though.

Should we be referring to UPS, DHL, Fed-Ex, etc as the “shippers”? In reality I think they should be known more as the “carriers” or “distributors”. The “shipper” would be the one sending the package.

To be precise Victor, I think you are exactly correct. Carrier is exactly what they are. However, it is generally felt that we ourselves are the shippers, and the seller is only acting as our agent.

As far as I understand it, this whole direct wine shipment thing (I could be wrong). Unfortunately every state has their own Alcoholic Beverage Control Board, it might go under different names but they do exist, New York State calls it the New York State Liquor Authority. For someone to produce wine or liquor within the state with the intent to sell they must be licensed in that state to do so. If someone wanted to ship or import wine into the state with the intent to sell it (or in the case of direct wine shipment, sold it, this is why wineries licensed in “outside” states before they could sell and ship wines to consumers in a reciprocating state) must first obtain a “shippers” license from that state to do so. For someone to “distribute” or transport wine or liquor within a state must also obtain a license within that state to do so. Surely the private carriers (UPS, DHL, FedEx, etc) used by “shippers” in the direct shipment of wine must first obtain a “fleet license” to carry and distribute alcoholic beverages within that state. Fore someone to sell wine within the state they must first obtain a state license to do so. This is done so that the state could regulate, control, and collect the appropriate taxes for alcoholic beverages sold in the state.
